Terms of Service

The terms for buying the Drift Tracker, taking out a Drift membership and using the Drift app.

1. About these terms

These terms apply when you buy a Drift tracker, take out a Drift membership or use the Drift app. "Drift", "we" and "us" means Drift, a small UK business. "You" means the person buying or using Drift. Please read them alongside our Privacy Policy and Shipping & returns page.

Nothing in these terms affects your legal rights as a consumer.

2. Who can use Drift

You must be 18 or over and live in the UK. Drift is designed for vehicles used in the UK.

3. What you are buying

Drift is two things that work together:

  • The Drift Tracker: a small OBD GPS device, a one-off purchase of £29.99.
  • Drift membership: £9.99 a month, or £99.00 a year where offered. Membership pays for the tracker's mobile data connection and the app features, such as the live map, journeys, places and Guardian alerts.

The tracker needs an active membership to send location data. Without one it will not show your vehicle in the app. Prices include VAT where it applies. The price you pay is the one shown at checkout.

4. Pre-orders and checkout

Checkout is not open yet. Until it is, the "Pre-orders open soon" form only registers your interest. No payment is taken and no contract is formed.

When checkout opens, payment will be taken securely by Stripe. A contract is formed when we email you to confirm your order. If we cannot accept your order (for example, if first-wave stock has run out), we will tell you and refund anything you have paid.

5. Membership, renewal and cancelling

  • Membership renews automatically each month (or each year on an annual plan) until you cancel.
  • Monthly membership can be cancelled at any time. Cancelling stops the next payment. Your membership stays active until the end of the period you have already paid for. We do not charge a cancellation fee.
  • Annual plans, when offered, follow the terms shown at checkout.
  • You can cancel in your account or by emailing [email protected].
  • You also have a legal right to cancel within 14 days of starting. See Shipping & returns.

If we change the membership price, we will tell you by email at least 30 days before the change applies to you, and you can cancel before then.

6. What Drift is, and is not

Drift is a consumer GPS tracker and app to help you see where your car is and get alerts. Please be clear on its limits:

  • Drift is not Thatcham-approved and is not an insurance-approved or insurance-grade tracking or recovery system.
  • Drift does not guarantee that a stolen vehicle will be found or recovered, and we do not provide a monitoring or recovery service.
  • Do not rely on Drift to meet an insurer's requirement for an approved tracker, and do not tell your insurer it is one.
  • GPS and mobile signal can be weak or missing, for example in car parks, tunnels and rural areas. Location may be delayed or inaccurate.
  • Drift is not an emergency service. If your vehicle is stolen or you are in danger, call the police on 999 (or 101 for non-emergencies).

7. Lawful use

You may only fit and use Drift on a vehicle that you own, or that you have the owner's permission to track. You must not use Drift to:

  • track, follow or monitor a person without their knowledge or consent
  • harass, stalk or intimidate anyone
  • break any law, including data protection law and the Protection from Harassment Act 1997

If other people regularly drive your vehicle, you must tell them it has a tracker. If you use Drift on a business vehicle driven by staff, you are responsible for telling them and for meeting your own data protection duties. We may suspend or close an account that we reasonably believe is being used unlawfully, and we may share information with the police where the law allows.

8. Fitting the tracker

The Drift Tracker plugs into your vehicle's OBD port and the app guides you through setup. Please follow the instructions and do not force the device into a port it does not fit. If your vehicle's port is in an awkward place or you are unsure, ask a qualified fitter. Fit the tracker where it will not get in the way of your pedals, steering or safe driving. Do not handle the app while driving.

9. Your account

Keep your login details safe and do not share them. You are responsible for who you give access to in the app. Tell us straight away if you think someone else has access to your account.

10. The service

We work hard to keep Drift running, but we cannot promise it will always be available or free from faults. We may need to carry out maintenance, and we may improve or change features over time. If we make a change that significantly reduces what you pay for, we will tell you and you can cancel and get a refund for any unused paid period.

If we ever need to stop offering Drift, we will give you at least 30 days' notice and refund any unused prepaid membership.

11. Our responsibility to you

If we break these terms or fail to use reasonable care and skill, we are responsible for loss or damage you suffer that is a foreseeable result. We are not responsible for loss that was not foreseeable, for business losses, or for losses caused by events outside our reasonable control.

Because Drift is not a recovery or insurance product (see section 6), we are not responsible for the theft of, or damage to, your vehicle or its contents, or for any loss of insurance cover.

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow us to limit. Your rights under the Consumer Rights Act 2015 are not affected.

12. Complaints

If something goes wrong, email [email protected] and we will try to put it right quickly.

13. Law

These terms are governed by the laws of England and Wales. You can bring a claim in the courts of England and Wales. If you live in Scotland or Northern Ireland, you can also bring a claim in your local courts, and the mandatory consumer laws of where you live still apply.

14. Changes to these terms

We may update these terms, for example when checkout opens. The version shown when you place an order applies to that order. For membership, we will email you about important changes at least 30 days before they apply.
